Terms of Service

1. Acceptance of Terms
By accessing or using the CapeCircle platform, mobile application, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
CapeCircle is a membership-based community platform for creators, entrepreneurs, and changemakers in Cape Town. The Service includes a website (www.the-capecircle.com) and an iOS mobile application, providing access to community events, partner perks, networking features, a member directory, and a referral program.
3. Membership & Eligibility
Membership is granted upon approval of your application and completion of payment. CapeCircle reserves the right to accept or decline any application at its sole discretion. You must be at least 18 years of age to use the Service.
4. Subscription & Payments
Membership requires a paid subscription, billed monthly or annually via Stripe. Prices are displayed during checkout and may be updated with prior notice. Subscriptions automatically renew unless cancelled before the renewal date. All payments are processed exclusively by Stripe, our third-party payment provider. CapeCircle does not use Apple In-App Purchase for subscription payments.
5. Cancellation & Refunds
You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period. Refunds are not provided for partial billing periods. You may also permanently delete your account through the website or iOS app settings (Settings → Delete Account), which immediately cancels your subscription and removes all associated data.
6. User Conduct
You agree to use the Service respectfully and lawfully. You shall not harass, abuse, or discriminate against other members. CapeCircle reserves the right to suspend or terminate accounts that violate these guidelines without refund.
7. Intellectual Property
All content, branding, and materials on the Service are the property of CapeCircle or its licensors. You retain ownership of content you post but grant CapeCircle a non-exclusive license to use it within the Service.
8. Limitation of Liability
CapeCircle is provided "as is" without warranties of any kind. To the maximum extent permitted by law, CapeCircle shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
9. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify members of material changes via email.
10. Mobile Application
The CapeCircle iOS application is available for download from the Apple App Store. By downloading and using the app, you also agree to Apple’s Standard Licensed Application End User License Agreement (EULA). The app requires iOS 17.0 or later. All subscriptions and payments are processed exclusively through Stripe — no purchases are made through Apple In-App Purchase. The app may receive updates from time to time; we recommend enabling automatic updates to ensure you have the latest features and security improvements.
11. Referral Program
Members may participate in the CapeCircle referral program by sharing their unique referral code. When a referred person completes their membership signup and first payment, the referring member receives a €5 credit applied to their next invoice. Referral credits are non-transferable, cannot be redeemed for cash, and are automatically applied via Stripe balance transactions. CapeCircle reserves the right to modify or discontinue the referral program at any time.
